Carlow man (62) sent forward to the local circuit court on poisoning charge

A CARLOW man was last week sent forward to the local circuit court, charged with attempting to poison his partner.

A book of evidence was served on Mark O’Neill, Cois na Coille, Pollerton Road, Carlow in the district court on Wednesday, where he was sent forward to the current sitting of the circuit court.

Mr O’Neill is charged under Section 12 of the Non-Fatal Offences Against the Person Act 1997, which states: ‘intentionally or recklessly administering, or causing to be taken, a substance which he/she knows to be capable of interfering substantially with the other's bodily functions’, arising from an incident that occurred on 20 August.

Mr O’Neill already pleaded guilty to the offence when he appeared before the court in October, but Judge Geraldine Carthy refused jurisdiction and sent the case back to the DPP’s office for new directions.

The court had heard that the allegation of poisoning arose when Mr O’Neill’s partner asked him to make her a sandwich and she allegedly found crushed tablets in it.

Last week, solicitor John O’Sullivan asked to be granted legal aid and for one counsel to represent Mr O’Neill (62) in the circuit court, which was granted by Judge Catherine Hayden.

The defendant was remanded on continuing bail and appeared before the current sitting of the circuit court.
