Judge refuses jurisdiction of assault case in County Carlow

JUDGE Geraldine Carthy last week refused jurisdiction in Carlow District Court of an assault case after hearing that an injured party had sustained a fractured nose. Eamon O’Reilly (70) The Watermill, Rathvilly appeared before the district court charged with assault causing harm at that address on 13 September last year, but when Sergeant James Kearney told her about the injuries sustained by the other party, she refused to hear the case on the grounds that it was too serious.

She then sent the case back to the DPP’s office for new directions and adjourned it until 5 November.
