Intoxicated man ‘couldn’t form a sentence’

He was found heavily intoxicated and bleeding in a Carlow estate

A 40-YEAR-OLD man who was found heavily intoxicated and bleeding in a Carlow estate has been fined €200 for a public order offence.

Mr Gareth Coakley from John Sweeney Park, Carlow appeared before Carlow District Court last Wednesday charged with an offence contrary to section 4 of the Public Order Act.

The court heard that in January of this year, Garda Kenny observed Mr Coakley on crutches at John Sweeney Park in Carlow town while on patrol. “He appeared to be very intoxicated, he couldn’t form a sentence,” Garda Kenny told the court, adding that the defendant appeared to be bleeding and in need of medical attention.

An ambulance was called and arrived over an hour later. Mr Coakley voluntarily accompanied the garda back to Carlow Garda Station and initially got into the ambulance when it arrived.

However, the court heard the ambulance returned to the station five minutes later because Mr Coakley refused to go to hospital.

“There was no alternative but to arrest him under section 4 of the Public Order Act,” Garda Kenny explained.

Defence solicitor Joe Farrell said in mitigation: “I’m not saying it’s only a section 4, but there isn’t a section 6 (threatening or abusive words or behaviour).” 

Judge Geraldine Carthy convicted and fined Mr Coakley €200 to be paid within 90 days.
