The man was arrested on Friday morning for alleged offences contrary to the Non-Fatal Offences Against the Person Act 1997.

Creeslough's original shop was the Applegreen Service Station which was completely destroyed in the huge blast.

Donegal County Council last month granted planning permission Vivo Shell Ltd to move forward with a new development on the site of the tragedy.

Damien Tansey said the Donegal County Council was behaving as “if this was a normal development case in respect of which planning permission was sought"

An application was made to develop a petrol station, shop and memorial garden at the site of the Creeslough explosion.

Judge John Aylmer said there was a risk of the “whole thing blowing up” had some individual gone around the back of the frequently-used building for a smoke.

A file will be prepared for the Director of Public Prosecutions, a garda statement said
